Terms of Service

Last updated: November 2025

Welcome to LetsGather. These Terms of Service (“Terms”) govern your use of the LetsGather platform (“Platform”). By using the Platform — whether as a Host or an Attendee — you agree to these Terms and our Privacy Policy.

1. Definitions

Throughout these Terms:

  • Host: A registered user who creates and manages events.
  • Attendee: An individual who applies to attend an event.
  • Platform: The LetsGather website, systems, and services.
  • Event: Any activity created or managed through the Platform.
  • Stripe Connect: Payment system where Hosts act as merchant of record.

2. Service Overview

LetsGather provides tools for event creation and booking. Hosts create events, Attendees apply, and Hosts may charge Attendees through Stripe Connect. LetsGather is not a party to transactions or responsible for event delivery.

3. User Roles

You may use the Platform as:

  • A Host (registered account).
  • An Attendee (no registration required).

4. Host Terms

4.1 Eligibility

Hosts must be at least 18 years old, legally capable of entering contracts, and comply with GDPR, tax, and consumer-protection regulations.

4.2 Host Account

You agree to provide accurate information, secure your credentials, and notify us of any unauthorized access.

4.3 Event Responsibilities

Hosts are fully responsible for:

  • Event accuracy, safety, legality, and delivery.
  • Refund, cancellation, and communication policies.
  • Compliance with tax and financial laws.
  • Honest representation of events.

4.4 Payments & Stripe Connect

Payments are processed through Stripe Connect. Hosts are the merchant of record and responsible for refunds, disputes, and chargebacks. LetsGather collects a service fee from Hosts.

4.5 Attendee Data

Hosts may access attendee contact data for event management and legitimate business needs. Hosts must comply with GDPR and use data only as permitted.

4.6 Account Deletion

Hosts may delete their account anytime. Data required by law (e.g., financial records) is retained; all other personal data is anonymized.

4.7 Prohibited Conduct

  • Creating, promoting, or hosting events involving violence, hatred, harassment, discrimination, or extremist activities;
  • Posting or facilitating illegal activities, including drug use, weapons, human trafficking, or unlicensed commercial services;
  • Hosting unsafe, hazardous, or dangerous events without proper safety measures, supervision, training, or compliance with local laws;
  • Publishing events unsuitable for minors without explicitly disclosing age restrictions, or requiring attendance of minors without appropriate parental or guardian supervision;
  • Posting adult-only, explicit, sexual, or pornographic content, whether written, visual, or in event activities;
  • Organizing events likely to cause physical injury, emotional distress, or psychological harm to attendees;
  • Providing false, misleading, or deceptive event descriptions, including omitting safety information or required legal disclosures;
  • Using attendee personal data for unauthorized marketing, profiling, or selling data to third parties;
  • Circumventing Platform fees, bypassing Stripe Connect, or manipulating payment flows in any way;
  • Violating intellectual property rights, trademarks, copyrights, or proprietary content of others;
  • Engaging in hostile, threatening, abusive, or disruptive communication toward attendees, staff, or other users;
  • Interfering with platform operations, attempting to hack, scrape, reverse engineer, or disrupt systems;
  • Any conduct that is unlawful, unsafe, unethical, or inconsistent with the purpose of creating safe and respectful events.

4.8 Enterprise customers (hosts)

Enterprise customers (host) may use their own database to store attendee and user data. In this scenario, LetsGather acts solely as a processor and does not control the personal data. The enterprise customer is responsible for ensuring compliance with applicable data protection laws, including GDPR and CCPA.

5. Attendee Terms

5.1 Eligibility

Attendees do not need to create an account but must provide accurate contact information when applying to events.

5.2 Communications

We send transactional messages only (confirmations, updates, cancellations). After events, attendee contact information may be shared with Hosts for legitimate business needs.

5.3 Payments

Payments are processed by Stripe. Hosts are responsible for refunds, disputes, and event delivery. LetsGather does not issue refunds.

5.4 Refunds & Disputes

Attendees must contact Hosts directly. Hosts' policies apply.

5.5 Liability

LetsGather is not responsible for event quality, cancellations, or Host behavior.

6. General Terms (Applicable to All Users)

6.1 Platform Availability

We strive to maintain availability but cannot guarantee uninterrupted service.

6.2 Prohibited Use

  • Illegal activity or fraud
  • System interference, scraping, or reverse engineering
  • Spreading harmful or malicious content

6.3 Intellectual Property

LetsGather owns all Platform IP. Hosts retain ownership of their event content but grant us a license to display it as necessary.

6.4 Data Protection & GDPR

Data is processed per GDPR and our Privacy Policy. Our own infrastructure is hosted in the EU. Some supporting services process data outside the EU under Standard Contractual Clauses, as described in the Privacy Policy. We do not sell personal data, and we use privacy-first, cookieless analytics that we host ourselves.

6.5 Limitation of Liability

LetsGather is not liable for indirect damages, event issues, or financial disputes. Total liability is limited to fees paid to LetsGather in the prior 12 months.

6.6 Termination

We may suspend or terminate access for violations of these Terms.

6.7 Third-Party Services

Stripe and other third-party services have their own terms. LetsGather is not responsible for third-party outages or issues.

6.8 Changes to Terms

We may update these Terms periodically. Continued use of the Platform indicates acceptance.

7. Governing Law

These Terms are governed by the laws of State of Florida, United States. Disputes shall be resolved in the courts of Miami, Florida, United States, unless mandatory consumer law requires otherwise.
